Grama  Sabha

Question No-1   What is Grama Sabha ?

Grama Sabha is a permanent institution constituted with all the dealt members of the Panchayat area having their names in the electoral roll of the Assembly constituency in respect of their G.P.

Question No-2 What is the power of the Gram Sabha?

(a) The power of the Grama Sabha is in approval of plans, programme and projects for social, Economic Development before such plans; Programme and projects are taken up for implementation by G.P.

(b) Identification or selection of person as beneficiaries under the poverty alleviation programme for similar other programmes.

(c) Certificate of utilization of funds by the Panchayats for the plan, programme and projects.

(d) Consideration of; levy of all taxes, rates, rents and fees and enhancement of rates thereof/

(e) Organisation of community service and drawal and implementation of agricultural production plans.

(f) Consideration of all such matters as may be referred to it by the G.P.

(g) Call for such information and data from the G.P. as it may consider necessary.

(h) Consideration as such other matter as may be prescribed.

Question No-3  Extra powers of the Grama Sabha in the schedule area.

(a) The Grama Sabha in schedule area be competent to safeguard and preserve the tradition and costume of the people, their culture, identity, community resources and costmary mode of dispute resolution, constituents in the relevant law enforce and in harmony with basic tenants of the constitution and human rights.

(b) Enforcement of prohibition or regulation or restriction of the sale and consumption of any intoxicant.

(c) Ownership of Minor Forest Produce.

(d) Prevention of alienation of land and restoration of any unlawfully alienated land of Scheduled tribe.

(e) Control over money lending to scheduled tribe.

(f) Management of local Market.

Election To The Wards Of The Gram Panchayat

Question No-1 Who is authorized to make the division of wards in a Gram Panchayat?

Answer- The collector has to make the division of wards in a Gram Panchayat.

Question No-2 What are the criteria for division of wards in a Gram Panchayat?

Answer-   

i) The total no. of wards in any G.P. shall not be less than eleven and more than twenty-five.

ii) The population of every ward shall as far as practicable be equal.

iii) Division of ward of a G.P. started form the northwest side of the G.P. and completed towards the east.

Question No-3 What is the procedure for reservation of Wards for Sheduled Caste (S.C.), Sheduled Tribe (S.T.), Women & Other Backward Class (O.B.C.)?

Answer- The wards of a G.P. shall be serially number of seats shall be reserved for S.C. & S.T. in each G.P. and no. Of seats for S.C. and S.T. shall bear as nearly as may be the same proportion to the total no. of seats to be filled up by direct election in that G.P. as the population of the S.C. & S.T. in the concerned G.P. bears to the total population of the G.P. and such seats shall be allotted by rotation to different wards in the G.P. The wards in which the density of population for S.C.& S.T. is higher shall be reserved for S.C.& S.T.

Not less than one third of total nos. of ward shall be reserved for Women. As nearly as may be, but not less than one third of wards meant for S.C.& S.T. shall be reserved for women belonging to S.C.& S.T. For the purpose, the list, which appears first, and then every third shall be reserved for women and till required quota is filled up.

There shall also be reservation for backward class citizens for not less than 27 % of the seats in non scheduled area s of the district out of seats remained unreserved after reservation of seats for S.C.& S.T. the required numbers of seats for backward citizens shall be made serially.

Question No-4  How many wards are there in the district in the last Panchayat Election?

Answer- There are 3405 wards in the district.

Question No-5  How many wards are reserved for S.C.S.T., O.B.C.& Women?

Answer- The reservations of wards for different categories are as follows

S.C.-358, S.T.-1624, O.B.C.-236, Un-Reserved (U.R.) -1187,

S.C. (W)-230, S.T. (W)-636,O.B.C. (W)-93,U. R. (W)-248.

Question No-6 Numbers of wards for which dereservation proposal was sent to Election Commission?

Answer- There are five wards for which dereservation proposal was sent to State Election Commission. They are ward no.04and 15 of Samna G.P., Ward No.13 of Bhagamunda G.P. ward no.5 of Tarimul G.P. and ward no.2 of Machhalo G.P.

Question No-7 How many by-elections are held?

Answer- The following numbers of bye-elections are held for the office of ward members

Question No-8 Is there any booth capturing in the last Panchayat election ?

Answer- Yes. There is booth capturing in 15 nos. of booths .

Answer- They Are Booth No.03 of Sarei G.P, No.13 of Batto G.P., 01 to 06 of Machhalo G.P.3 and 10 of Daradipal G.P.6 of Pithagola G.P.1, 16 and 17 of Gadabandhagoda G.P.

Election Of Sarapanch Of The Gramapanchayat

Question No-1 How many G.Ps. are there in Keonjhar District?

Answer- There are 244 G.Ps in Keonjhar District.

Question No-2 How many Sarpanches there in Keonjhar District?

Answer- There are 244 Sarpanches in Keonjhar District.

Question No-3 Is there any provision for reservation of seats for Sarpanches?

Answer- Yes. There is provision for reservation of seats for Sarpanches for S.C.,S.T. & Women category.

Question No-4 Is there any provision for reservation of seats for Sarpanch for Backward class citizens?

Answer- No. There is no provision for reservation of seats for Sarpanch for Backward class citizens.

Question No-5 What is the procedure of reservation for S.C., S.T. & Women category?

Answer- Taking the Block as the Unit, the G.P. in which the density of population of S.C. or S.T. is higher, the office of the Sarpanches in the G.P.s shall be reserved for S.C. or S.T. by the Collector and shall rotate in the descending order at every General Election.

At first the names of the Gramas within the Block shall be arranged in Oriya alphabetical order. The required seats meant for S.C. shall be reserved at the first instance and then for S.T. Not less than one third of total no. of wards shall be reserved for women. Reservation of wards for Women belonging to S.C. shall be made first and then for S.T. For the purpose, the G.P. which appears first and thereafter every third shall be reserved for Women until required quota is filled up. The same procedure is also followed for reservation of unreserved seats for women.

Question No-6 How many seats of Sarpanches are reserved for S.C.,S.T. & Women?

Answer- The reservation of seats for the office of Sarpanches are as follows:

Question No-7 Is there any bye-election to the office of Sarapanch after the last general Panchayat Election?

Answer- Yes. Bye Election to the office of Sarpanch Bhagamunda, Anseikala, Kodagadia, Badaneuli, and Safdanga G.P. are held after last Panchayat Election. Apart form this, bye-election for the office of Sarapanch, Naranpur G.P. and Raikala G.P. is scheduled to be held on 21.09.2000 and 03.10.2000.

Election Of Zilla Parishad, Keonjhar

Question No-1 For which category of seat of President, Keonjhar Zilla Parishad is reserved?

Answer- It is unreserved.

Question No-2 How may no. of Zilla Parishad constituencies are there in Keonjhar District?

Answer- There are 37 nos. of Zilla Parishad constituencies in Keonjhar District.

Question No-3 What are the criteria for constitution of a Zilla-parishad Constituency?

Answer-

i) shall have a population of 40,000 or part thereof.

ii) does not extend beyond the territorial limit of the Block.

iii) the territorial area of a Grama is not bifurcated.

iv) is compact with due regard to geographical feature.

Question No-4 What is the reservation procedure of Zilla Parishad Constituencies?

Answer- The Zilla Parishad Constituencies are reserved for S.C. & S.T. according to their density to the total population of the District.. The constituencies in which the density of population of S.C.& S.T. is higher is reserved by the Collector for S.C. & S.T. respectively. 27% of total nos. of seats is reserved for Backward class citizen in non-schedule area and one third of the total Nos. of seat reserved for each category shall be reserved for Women.

Question No-5 What is the procedure of naming the Constituencies?

Answer- The constituencies of the District bear the names pf respective Blocks and arranged seriall7y in Oriya alphabetical order and the name of every constituency so arranged serially shall include its serial number in the District.

Question No-6 What is the procedure for reserving seats for Women?

Answer- After the names of Constituencies arranged in Oriya alphabetical order, the reservation for women are made as follows:

I) For the first instance the reservation for Women for S.C. is made & then for S.T. Not less than one-third nos. of seats reserved for S.C., S.T. & O.B.C. shall be reserved women belonging to the S.C.,S.T. & O.B.C. respectively. Out of the seats reserved for S.C.,S.T. & O.B.C. the constituency which appears 1^st and then every third constituency is reserved for women until the required quota is filled up.

Question No-7 How many seats of Z.P. Constituency are reserved for S.C.?

Answer- 04 nos. of seats of Z.P. members reserved for S.C.

Question No-8 How many seats are reserved for S.T.?

Answer- 17 nos seats are reserved for S.T.

Answer- 03 nos. of seats are reserved for O.B.C.

Answer- Yes.

Election Of Panchayat Samiti In Keonjhar District

Question No-1  How many Panchayat Samiti Constituencies are there in Keonjhar District?

Answer- There are 244 Panchayat Samiti Constituencies in Keonjhar District.

Question No-2 What is the criteria for constitution of a Panchayat Samiti Constituency?

Answer- The Samiti area is divided into P.S. constituency as per the following criteria.

i) have a population of not less than 2000 & more than 10,000 population.

ii) the territorial area of a Gram is not bifurcated.

Question No-3 How the P.S. constituencies are named?

Answer- Every P.S. Constituency bear the same name as of the Grama and the names are arranged serially in Oriya alphabetical order.

Question No-4 What is the reservation procedure for P.S. Constituency?

Answer- The P.S. constituency of a Block are reserved for S.C., S.T. according to their density to the total population of the Panchayat Samiti. The constituency in which the density of population of S.C.& S.T. is higher shall be reserved for S.C.& S.T. and shall rotate in descending order at every general election. After reservation of seats for S.C. & S.T., the rest will be left for general category. Not less than twenty-seven percentage of the total no. of seats to be filled up by direct election shall be reserved for backward class in non-schedule area. The seats calculated for reservation if back Ward class shall be taken up at first instant serially out of seats meant for general category.

Question No-5 How many Panchayat Samiti are there under non-schedule area?

Answer- There are 3 Panchayat samities are in non-schedule area. They are Anandapur, Ghasipura and Hatadihi.

Question No-6 What is the procedure for reservation for Women?

Answer- Out of the total seats of the Block, the sent not less than one-third shall be reserved for woman. Out of the total seats meant for Women, not less than one third of the Constituencies reserved for S.C. & S.T. member shall be reserved for women belonging to the S.C.& S.T. After the constitution are arranged serially in Oriya alphabet, the reservation for S.C. Women is made at the first instant and then for the S.T. For the purpose of the constituency which appears in the second and thereafter every third constituency shall be reserved for Woman till required quota is filled up.

Question No-7 How many seats of P.S. Members are reserved for S.C. category?

Answer- 25 seats are reserved for S.C. category.

Question No-8 How many seats are reserved for S.T. category?

Answer- 117 seats are reserved for S.T. category.

Answer- 16 seats are reserved for O.B.C. category.

Question No-10 How many seats of P.S. member are reserved for women?

Answer- The seats of P.S. member are reserved for Women as follows:

Question No-11  Is there any bye-election to any P.S. Constituency?

Answer- Yes. The Bye-election to the office of Panchayat Samiti Member, Gumura G.P., Baunsagarh, Kandara G.P., Turumunga G.P. and Badapalaspal G.P. were held after 3 tier Panchayat Election.

Question No-12 Whether the reservation procedure is applicable for the office of Chairman?

Answer- Yes. The reservation of offices of Chairman shall be made by the Collector by rotation among different Samities for S.C. & S.T. by the same procedure made for the P.S. MEMBER TAKING THE Dist. Population as the Unit. The Block where the density of population of S.C. & S.T. in the district is higher, the seat shall be reserved for S.C. or S.T. accordingly.

Question No-13 How many seats of Chairman are reserved for S.C. & S.T. category?

Answer- Out of 13 seats of P.S. Chairman I Keonjhar District, one seat is reserved for S.C., 06 nos of seats are reserved for S.T. and 06 nos of seats are un-reserved.

Question No-14 Is there any reservation of s4eat of Chairman for O.B.C. citizens?

Answer- No. There is no provision for reservation of seats for the O.B.C. citizens in case of Chairman.

Question No-15 How many bye-elections are held for the office of Chairman?

Answer- The bye-election are held for the office of Chairman of Harichandanpur, Keonjhar and Joda Panchayat Samities.

Information on auction sale of public Properties transferred to Gram Panchayats

Question No-1 What are the properties transferred to G.Ps in its management?

Answer- a) Tank & Bandha, b) Ferry Ghat, c) Cattle pound, d) Waste land, e) Bagayat.

Question No-2 Can the G.P. establish a market in its G.P. area?

Answer- Yes. G.P. can establish the market by its resolution and demarcated the place market.

Question No-3 Can the G.P. establish the Cattle pound?

Answer- Yes. The G.P. can establish the cattle pound but prior to establishment, approval of the Collector for establishment of Cattle pound is necessary/

Question No-4 Who is competent to fix up the upset price for auction sale of G.P. properties?

Answer- The Sub-Collector concerned is competent to fix up the period of lease and minimum up-set price for auction sale of G.P. properties.

Question No-5 What is the period of lease of the properties?

Answer- Ten years lease of tank has been abolished. The Sub-Collector can fi9x up the period of lease form one year to three years.

Question No-6 Who is competent to conduct the auction sale of public properties of G.P.?

Answer- a) The G.P.E.O. is competent to conduct the auction sale of public properties whose up set price is within Rs.5000/-.

b) The B.D.O. concerned is competent to conduct auction of all properties of G.Ps. whose upset price has been fixed up by Sub-Collector.

Question No-7 Who is competent to confirm the auction sale of G.P. properties?

Answer- a) The B.D.O. is competent to confirm the auction sale of G.P. properties conducted by his G.P.E.O., whose upset price is upto Rs. 5000/-.

b) Sub-Collector concerned is competent for confirmation of Bid of public properties auctioned by B.D.O.

Question No-8 What is the number of installment for collection of lease money?

Answer- a) At first time, 75% shall be collected as first installment of Bid money.

b) Rest 25% shall be collected in the second installment.

Question No-9 Who is competent to ask the bidder to deposit lease money and registration of agreement deed ?

Answer- The B.D.O. is authorized Officer U/R –87(k) of O.G.P. Rules, 1968 to direct the leasee to deposit the first installment and sign registered agreement deed with the concerned Gram Panchayat.

G.P. Secretary

Question No-1  Who is appointing authority of the G.P. Secretary ?

Answer- Gram Panchayat is appointing authority for the post of G.P. Secretary. After selection by interview, G.P. shall send the proposal to G.P.E.O. concerned for its approval with prior approval of District Panchayat Officer.

Question No-2 What is the Scale of pay of G.P. Secretary?

Answer- a) The Govt. have fixed up the consolidated pay of Rs. 2200/- of G.P. Secretary per month.

b) For other staff, there is no rank fixed by Govt. For increase of pay of Peon, Sweeper and other staff of G.P., the G.P. decided in the meeting and sent it to D.P.O. for its approval. After approval of the D.P.O., the G.P. authorised for payment of enhanced pay.

Question No-3 If the G.P. Secretary is not working and not hearing any complain, before whom the public can file complain ?

Answer- Before the Sarapanch with the specific objection.

Question No-4 If the decision of the G.P. is not satisfactory before whom the complainer it is file complain?

Answer- He will file appeal before the Sub-Collector against the G.P.

Question No-5 If the complainant is not satisfied with the order of the Sub-Collector, the before whom he will file his appeal?

Answer- He shall file the second appeal before the Collector and his decision is file.
